The law of May 21, 2024 on the regulation of the digital space has just been published in the Journal Officiel of May 22, 2024. It was passed in application of European regulations on digital services (Digital Service Act) and digital markets (Digital Market Act).

Its aim is to secure and regulate the digital space. It includes protective measures for Internet use (for children, against pornography, cyber-harassment and online hate). It regulates the practices of Internet gatekeepers ( 6 platforms were designated gatekeepers by the European Commission last September: Alphabet (Google, Chrome, Android, Youtube), Amazon, Apple (iOS, Safari, App Store), ByteDance (TikTok), Meta (Facebook, Instagram, Whatsapp, Messenger) and Microsoft (Windows, LinkedIn).

For example, they will no longer be able to impose default software when installing the operating system, nor pre-install certain software applications, nor favor their own products or services on their platforms over those of other vendors, nor reuse personal data collected during one service for the needs of another, without the user’s effective consent having been given. This list is not exhaustive. The text also aims to reduce companies’ dependence on cloud operators, and regulates the practice of online gaming.
